In these terms and conditions, references to “Times World Adventure”, “we”, “us”, or “our” mean Times World Adventure Limited. References to “you”, “your” and “your party” refers to you and all persons names on your booking.

Our agreement with you defines what you are legally entitled to expect from us and our third party suppliers when you purchase travel services through us. We sell a variety of services and you should make sure you understand the terms and conditions which apply to your particular arrangements in addition to these general terms and conditions.

Reservations & Payments

Our offers are subject to availability at the time of booking; we cannot block all services at the quotation stage. We will inform you the payment policy for your booking at the time of confirmation but please be aware we work on full pre-payment basis. Our usual policy requires 30% deposit at the time of confirmation which enables us to hold the reservation for you, then full balance payment up to 1 month prior to arrival but these conditions could vary depending on the type of booking.

Conditions Of Travel

No refund is given for lost travel (no shows), change of facilities, itineraries amended after arrival or any circumstances arising beyond our control necessitating alternative arrangements being made to ensure the safety and/or further participation and enjoyment of your program. The participants must strictly follow the program tailored for the group; failure to do so shall under no circumstances be entitled to any refund.
We are not liable if the participants are not on time causing the program to be modified, delayed or not completed in full.

Cancellations & Amendments

Cancellation and amendment terms will be advised to you at the time of booking.
Any cancellation or amendment must be in writing and should be received by us from Monday to Saturday between 08.30h – 17.00h EAT; not including public holidays. These will be then confirmed to you by email. Cancellations and amendments made outside of these hours will be deemed to be made on the next working day (Monday to Friday). Changes in bookings are subject to the supplier’s cancellation and amendment policies.

Travel Documentation

All participants should hold valid passports and visas required for their itinerary. It is your responsibility to fulfill the passport, visa and any other immigration requirements applicable to your itinerary. We do not accept any responsibility if your participants are unable to travel due to non-compliance with any such requirements.

Complaints

We will make every effort to ensure that our services are provided without fault. If you have any cause for complaint while travelling, you must immediately bring it to the attention of our local representative. Outside of office hours you/client should use the emergency number provided on the “Final Program”.
We will do our best to rectify the problem immediately. If the client fails to mention any complaints as per above, eligibility to compensation may be affected as we will have been deprived of the opportunity to rectify the problem.
All complaints must be sent to us within 14 days of the end of the itinerary. We will not accept any complaints after this time.

Liability

We are not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, we are not responsible for any injury, loss, death, sickness, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also, be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to your standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner’s risk. The prices of these tours are based on current rates in effect (including foreign exchange rates, fuel costs, taxes) at the time of booking and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that we are not liable for any consequential loss or damage.

Health & Insurance

It is your responsibility to ensure you are aware of any health requirements of your travel destinations and to ensure that you carry all necessary vaccination documentation. It is your responsibility to ensure the participants do not have any medical that you are unaware of that may affect their abilities to take part in all activities in the itinerary.
We strongly recommend the participants acquire adequate insurance cover, including health, life and property loss/damage.
Please advise your consultant of any special requirements you may have, for example, special meals, medical requirements and so on.

Hotel

Standards, facilities and locations vary from across hotels; please ensure you are happy with what is offered before confirmation as we may not be able to change at a later stage. Many hotels in Africa may not be having air conditioning or fans.

Child Policy

Specific child policies will be advised at the time of booking, the general policy is as follows.
Infants (0-2yrs old) are free of charge. Cots are subject to availability at the time rooming list is received. Child (3-11yrs old) pays 65% of adult cost. Child rate is only valid when sharing a room with 2 full paying adults.
A maximum of one child is allowed to share a room with 1 or 2 full paying adults; extra beds are subject to availability at the time the rooming list is received by the hotel.
Different prices will apply for family rooms that can accommodate 2 adults and 2 children – these rooms are subject to availability at the time of booking. We are not responsible if the participants do not reside according to the rooming list, extra charges may apply.

Meals

All meals included will be advised to you at the time of booking, including menu type and number of courses. Drinks are not included unless specified. We should be informed in advance of any special dietary requirements (Vegan, Halal, Jain, Allergies, etc.). No compensation is claimable where meal/s are missed by tour participants at his/her own will or due to late/non arrival at arranged meal timings.

Safari Van/Coach

According to Kenyan law and indeed the transport laws in many African countries, all participants including the tour leader must wear safety belts when the vehicle/coach is in motion. Any passengers not following the safety rule will do so at their own risk. We will not be held responsible for any consequences followed thereafter.
In general we advise participants not to leave behind any high value items including all baggage and personal property on the coach these remain your responsibility and we will not be liable in case of theft or robbery of items from the coach.

Dispute

This Agreement is subject to the law and jurisdiction of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
